The defendant-appellant Lynn Midell was convicted of selling marijuana in violation of sec. 161.275 (1), Stats., and sentenced pursuant to sec. 161.28, as a second offender to a term of five years in the state prison. Trial was to the court, a jury trial having been waived by the defendant. The defendant did not testify at the trial and no defense was offered to the charge. Five issues are presented for determination on this appeal.
